Candidates must respond to their ITA with a complete application for permanent residence (PR) if they want to immigrate to Canada. Once a candidate applies, they are now an applicant.
If the information provided in an application by the applicant is found to be false, it is considered misrepresentation and may result in penalties, depending on the nature and seriousness of the false claim.
Misrepresentation provisions aim to ensure that applicants submit complete, honest, and truthful information in all respects when applying to enter Canada and to maintain the integrity of Canadian immigration programs.
An applicant who is determined to have submitted false information when entering the Express Entry pool can be barred from re-entering the pool for five years. As such, it is critically important to always provide accurate and correct information.
An applicant can be deemed inadmissible to Canada due to misrepresentation if they directly or indirectly misrepresent or withhold material facts related to a relevant matter that leads or could lead to an error in the processing of their application. The applicant bears responsibility for ensuring the truthfulness of the application and the authenticity of supporting documents, and may be found to have committed misrepresentation regardless of whether it was done intentionally.
